It is submitted that as per order show cause notice was issued to the unit to explain how they have established their unit without obtaining consent to establish and started operation without obtaining consent to operate from our department vide no. CPCC/3152/2016/1408 on dated 25.07.2016. In response of which unit informed that they were applied for consent to establish for their restaurant much before the operation of the restaurant. They further informed that they have completed all the desired requirements and further requested to withdraw the showcause notice issued vide no. CPCC/3152/2016/1408 on dated 25.07.2016.

M/s IGNITE VENTURES

Sub:  Confirmation of Directions U/s 33 A of Water (Prevention & Control of Pollution) Act, 1974 and 31 A of Air (Prevention & Control of   Pollution) Act, 1981.

It is submitted that unit namely M/s Ignite Ventures at SCO No. 184, Ground floor, Sector 7-C, Chandigarh applied for consent to operate for running a restaurant under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 under Orange category. Unit has been established without obtaining consent to establish and started operation without obtaining consent to operate from our department. Showcause notice was issued to the unit vide no. CPCC/3152/2016/1408 on dated 25.07.2016 to explain how they have established their unit without obtaining consent to establish and started operation without obtaining consent to operate from our department, proposing following directions U/s 31A of Air (Prevention & Control of Pollution) Act, 1981 and U/s 33A of Water (Prevention & Control of Pollution) Act, 1974:

1. That the proprietor will close unit forthwith.

2. That they will not run unit before the consent is granted by CPCC.

3.That the concerned authorities shall disconnect the supply of electricity and water to the unit with immediate effect and send report of compliance.

4.  That the concerned authorities shall seal the unit with immediate effect and send report of compliance.

  In response of which unit informed that they were applied for consent to establish for their restaurant much before the operation of the restaurant. They further informed that they have completed all the desired requirements and further requested to withdraw the showcause notice issued vide no. CPCC/3152/2016/1408 on dated 25.07.2016. As the reply of unit is unsatisfactory (CPCC has already given public notices in various leading newspapers many times, regarding awareness w.r.t. Consent). In view of the above, it is therefore, proposed that we may confirm the abovesaid directions issued vide showcause notice no. CPCC/3152/2016/1408 on dated 25.07.2016.                 

     Further, as per decision taken in 62^nd Governing Body meeting of CPCC; prosecution case may be filed against the unit in the court of Chief Judicial Magistrate and Sh. Anil Kumar, JSA, CPCC may be authorized to file the case on behalf of Chandigarh Pollution Control Committee.

Chairman, CPCC is competent to accord approval in this case.

It is submitted that Sh. Amarbir Singh Bhullar, partner of the unit namely M/s Ignite Ventures at SCO No. 184, Ground floor, Sector 7-C, Chandigarh has applied for Consent to Operate for running a restaurant. Undersigned has inspected the unit on 30.06.2016 and found everything in order from pollution point of view i.e they have installed Oil & Grease trap for the treatment of waste water, DG set which is equipped with acoustic enclosure and their test reports indicate that they fulfill the environmental norms.

Later, as per the decision taken by Governing Body in its 62nd/63rd meeting, a letter has been sent to the unit to close down their unit and submit an affidavit that they will close their unit and will not run till the permission is granted by CPCC. In response to that they have submitted an affidavit stating that they have closed down their unit and will run only after taking permission from CPCC.

Undersigned has inspected that unit on 28.11.2016 and verified that the unit was closed at the time of inspection.

Hence kindly put up the case in next technical committee meeting for further technical comments and their remarks in this regard.

             Hence, as per the recommendations of Technical Committee (uploaded at link "view letter") and inspection report, it is proposed to grant Consent to establish and consent to operate with usual terms and conditions.

             Worthy Vice-Chairman is competent to grant consent in this case (being ORANGE category).
